Section 125 Plans

As noted above, ERISA requires that an employer maintain plan documents for any of the employee benefit plans it governs, and section 125 plans. Section 125 plans come in many varieties including “cafeteria plans,” premium-only plans and flexible benefit plans. We have found that many of the most common compliance issues come from section 125 plans that are not adequately documented. We have developed with our attorney; template section 125 plans our clients may adopt and implement that will assist them in complying with the Tax Code requirements that apply to section 125 plans, as well as ERISA.
